Judge Nicolas Coleman barred Roger Martin from having any “sexually stimulating drugs, such as Viagra” after he learned Martin was being prescribed the impotence medicine, Peterborough Crown Court was told.

Martin, from Peterborough, Cambs, admitted sexual assault on a child after inappropriately touching an 11-year-old victim on December 27 last year.

When he was sentenced on August 17 he was spared a prison term but was put on a sex offenders’ programme for three years and barred from contact with children and told he could not work with them.

However, he was still able to claim for the drug as the probation service could not intervene and doctors could not take his criminal record into account.

So Judge Coleman called Martin back to court last Friday and told him he was not to be permitted to have any sexually stimulating drugs, such as Viagra, in his possession unless prescribed by a GP for a clinical need.

He was also told he must tell police whenever he has any such drugs in his possession.

A spokesman for the Cambridgeshire Probation Service said: “We could not, and would not, restrict the use of a prescription medication, be it Viagra or anything else.

“What we do is do our utmost to help sex offenders address their offending behaviour.”
